Terms of Service

1. What GICATI is

GICATI provides a restaurant management platform (the “Service”) accessible at gicatipos.com. The Service includes: a customer QR menu, online ordering, a waiter POS, a kitchen display, staff management, cash-shift management, WhatsApp marketing, and admin tools.

By creating an account or using the Service, you (“the Restaurant”, “you”, or “your”) agree to these Terms.

2. Your account

You are responsible for keeping your login credentials secret. You are responsible for all activity under your account — including anything your waiters, managers, or staff do while signed in. Notify us immediately at hello@gicatipos.com if you believe your account was compromised.

You may not share your account with restaurants you don’t own or operate. One account = one venue (except the Hotel tier, which permits multiple in-house restaurants under one account).

3. Pricing & billing

The Service is offered on three tiers (Starter, Business, Hotel). Prices are shown at gicatipos.com/for-restaurants. Prices are in Iraqi Dinar (IQD).

Billing is monthly, in advance.
Payment is due within 7 days of invoice.
Overdue accounts may be suspended (menu still visible; ordering and POS disabled).
Setup and onboarding is free for standard tiers.
The first month may be discounted or free at GICATI’s discretion for new customers.

GICATI does not take a percentage of your sales. Cash sales are 100% yours. Card / digital wallet payments (when live) may carry the underlying processor’s fee (e.g., FIB, FastPay, Zain Cash) — which is transparent and passed through unchanged.

4. Refunds & cancellation

You may cancel any time from your /admin panel or by emailing hello@gicatipos.com. Cancellation takes effect at the end of the current billing month — no refund is given for the remainder of that month.

On cancellation, we provide a CSV export of your menu, customer list, and sales history within 14 days. After 90 days your data is permanently deleted unless required to be retained by law.

5. Data ownership

Your data belongs to you. Menu, sales, customer list, staff records — you own all of it. GICATI processes it on your behalf, and you remain the data controller for personal data of your customers and staff. See our Privacy Policy for details on how we handle it.

You grant GICATI a limited license to display, store, and process your data as needed to operate the Service (e.g., show your menu to your customers).

6. Acceptable use

You agree not to:

Use the Service to sell illegal goods, services, or content prohibited under Iraqi law.
Send spam or unsolicited marketing (WhatsApp campaigns are opt-in only).
Reverse-engineer, decompile, or attempt to access GICATI’s source code.
Attempt to overload, hack, or disrupt the Service.
Resell the Service to third parties without written permission.

Violation may result in immediate suspension without refund.

7. Uptime & support

We aim for 99% uptime but do not guarantee it. Support is provided via WhatsApp and email during Erbil business hours (Sun–Thu, 9:00–18:00). Business and Hotel tiers get priority support with target response times of 2 hours and 30 minutes respectively.

Scheduled maintenance is announced at least 24 hours in advance where possible.

8. Intellectual property

GICATI, the Pay4 platform, all code, logos, and brand assets are owned by GICATI. You may not use them commercially without permission.

Your menu content, photos, logo, and brand are yours. Uploading them grants us a limited license to display them within the Service.

9. Liability limits

The Service is provided “as is”. To the maximum extent permitted by Iraqi law, GICATI’s total liability for any claim is limited to the fees you paid us in the 3 months before the claim arose.

We are not liable for indirect damages — lost profits, lost customers, spoiled ingredients, or reputational harm from an outage.

10. Changes to these Terms

We may update these Terms. Material changes will be emailed to you at least 30 days before they take effect. Continued use after that date means you accept the changes.

11. Governing law & disputes

These Terms are governed by the laws of the Kurdistan Region of Iraq. Any dispute will be resolved in the courts of Erbil, unless both parties agree to mediation first.
